Privacy & HIPAA Notice

This page has two parts. First, our HIPAA Notice of Privacy Practices, which explains how protected health information is used and disclosed in the course of dispensing your prescriptions. Second, a separate notice covering privacy and cookies on this website.

Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Elite Care Pharmacy is required by law to protect the privacy of your protected health information, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. Protected health information is information that identifies you and relates to your past, present, or future health, the care you receive, or payment for that care.

How we may use and disclose your health information

We may use and disclose your protected health information, without a separate authorization from you, for treatment, payment, and health-care operations:

  • Treatment. We use your information to dispense and counsel on your medications and to coordinate with your prescriber and other providers involved in your care. For example, a pharmacist may contact your physician to clarify a prescription or to review possible drug interactions.
  • Payment. We use and disclose your information to bill and obtain payment for the medications and services we provide. For example, we may share information with your health plan or pharmacy benefit manager to confirm coverage and process a claim.
  • Health-care operations. We use your information to run and improve the pharmacy. For example, we may use it for quality review, staff training, licensing, credentialing, compliance activities, and internal recordkeeping required of a licensed pharmacy.

We may also use or disclose your information in limited circumstances permitted or required by law, such as for public-health activities, to report a suspected adverse drug event, to comply with a court order or other legal process, or as otherwise required by federal or Texas law.

Uses and disclosures that require your authorization

Other uses and disclosures of your protected health information will be made only with your written authorization. This includes most uses and disclosures for marketing purposes and any sale of your information. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

Your rights regarding your health information

  • Access and copies. You have the right to inspect and obtain a copy of the health information we maintain about you.
  • Amendment. You have the right to request that we amend health information you believe is incorrect or incomplete.
  • Accounting of disclosures. You have the right to request a list of certain disclosures we have made of your health information.
  • Restrictions. You have the right to request restrictions on how we use or disclose your information. We are not required to agree to every request, except as required by law.
  • Confidential communications. You have the right to request that we communicate with you in a certain way or at a certain location.
  • Paper copy. You have the right to a paper copy of this notice, even if you have agreed to receive it electronically.
  • Complaint without retaliation. You have the right to file a complaint, and we will not retaliate against you for filing one.

Our duties

  • Maintain the privacy of your protected health information.
  • Provide you with this notice of our legal duties and privacy practices.
  • Abide by the terms of the notice currently in effect.
  • Notify you following a breach of unsecured protected health information as required by law.

We reserve the right to change this notice and to make the revised notice apply to information we already have as well as information we receive in the future. A current copy of this notice will be made available on this website and at the pharmacy.

How to file a complaint

If you believe your privacy rights have been violated, you may file a complaint with the pharmacy's Privacy Officer:

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights (HHS/OCR). We will not retaliate against you for filing a complaint.

Website privacy & cookies

This section covers privacy on this website. It is separate from the HIPAA Notice of Privacy Practices above.

This website does not collect protected health information. It has no contact form and no way to submit prescriptions, medical details, or other sensitive information online. The site uses only essential, first-party storage needed to function.

Cookies and consent

A cookie-consent banner appears on your first visit and defaults to declined. We do not set analytics or advertising cookies unless you choose to accept. The only thing the site stores is your consent choice, saved as a first-party "consent" value in your browser's localStorage. No third-party tracking or advertising cookies are set by default.

You can change your choice at any time using the Cookie preferences link in the footer, which reopens the consent banner.

This web-privacy notice describes only how the website behaves. It is separate from, and does not replace, the HIPAA Notice of Privacy Practices above, which governs how the pharmacy handles your protected health information.
